Paradise Park, just off the R43 in Vermont and situated on private land, was sold in 2017. An eviction application was served on the residents of Paradise Park in terms of the Prevention of Illegal Eviction Act (PIE).
Where an eviction is sought and the possibility exists that it may be granted, the Municipality’s constitutional obligation to provide emergency accommodation is triggered. The Municipality is therefore obligated to provide temporary emergency accommodation for those who will be left homeless.
Emergency accommodation does not mean formal housing, but a plot with shared services where a temporary structure can be erected.
Overstrand Municipality was listed as a Respondent in the Eviction order application and as such should any residents be left genuinely homeless because of the eviction order, must provide a housing report outlining what steps the Municipality proposes to address this and make temporary emergency accommodation available in which the affected families can be accommodated.
In response to this, the Council of Overstrand Municipality resolved in 2018 that plots for emergency housing be allocated within the Stanford Housing Development.
Residents of Paradise Park were afforded the opportunity to register their housing needs to be considered for state subsidised housing; 28 households completed applications for emergency housing in Stanford. Of the 28 households, 20 applicants are 60 years and older and three are also disabled. All other evictees will be offered the opportunity to temporarily be accommodated in the Hawston Thusong Hall.
The Municipality will provide the following services and housing for the 28 household applicants for the emergency housing in Stanford:

- 1 toilet for every 5 households (including a disabled friendly toilet).
- 1 tap for 20 household. Additional taps may be installed to ease the access for the elderly.
- A 24m2 informal housing unit per applicant. The mentioned housing unit will remain the property of the Municipality and a vacant unit can be offered to any other applicant for emergency housing in future.
The Municipality will provide transport where required (furniture, other belongings and affected households) from Paradise Park to the emergency housing site, subject to applicants indemnifying the Municipality against any damage or loss.
No existing temporary structures or caravans owned by the applicants will be accommodated at the Stanford emergency housing site.
It is foreseen that the occupation of the mentioned emergency housing units can commence at the earliest on 1 October 2022.
The Social Compact and the community of Stanford were informed of the decision to accommodate the residents of Paradise Park at Stanford.
